The Montenegro Buying Process

Step 1: Property Search

Start by browsing listings on MontenegroHousing or working with our AI assistant to identify properties matching your criteria. Define your budget (including all costs — see our Cost Calculator), preferred area, and property type before engaging with agents.

Step 2: Engage a Lawyer

This is mandatory before signing anything. Hire an independent Montenegrin lawyer — not one recommended by the selling agent. Your lawyer will:

  • Verify the seller's title (vlasnički list / list nepokretnosti)
  • Check for mortgages, liens, or encumbrances
  • Confirm building permits and legal status
  • Draft and review all contracts

Expect to pay €500–1,500 for full legal representation.

Step 3: Preliminary Contract (Predugovor)

Once you've found a property, a preliminary contract is signed and a deposit of 10% of the purchase price is paid. This contract is legally binding. If the buyer withdraws, the deposit is forfeited. If the seller withdraws, they must return double the deposit.

Step 4: Due Diligence Period (2–8 weeks)

Your lawyer conducts full due diligence:

  • Title search at the Real Estate Cadastre (UPN)
  • Planning and permit checks at the local municipality
  • Tax arrears check
  • Encumbrance search

Step 5: Final Notarised Contract (Glavni Ugovor)

The final contract is signed before a Montenegrin notary (javni bilježnik). Both parties must attend or provide power of attorney. The balance of the purchase price is transferred at this point.

Payment: Wire transfer is standard. Cash transactions above €10,000 are prohibited by law.

Step 6: Property Tax and Registration

Within 30 days of signing, your lawyer must:

  • Pay the 3% Transfer Tax (Porez na prenos nepokretnosti) to the Tax Authority
  • Register the new ownership at the Real Estate Administration (UPN)

Timeline: Full process typically takes 4–12 weeks from signing the preliminary contract.

Tips for Foreign Buyers

  • Bank account: Open a Montenegrin bank account for the transaction (many banks welcome foreign buyers)
  • Power of Attorney: You can appoint your lawyer to act on your behalf for all stages
  • Currency: Montenegro uses the Euro (EUR) — no currency risk for Eurozone buyers
  • VAT: New builds from developers are subject to 21% VAT, typically included in the advertised price
