Why Due Diligence Matters

Montenegro's property market has seen rapid development and some properties carry legal issues that a buyer must identify before purchase. A thorough due diligence process protects your investment.

Title Verification

The List of Real Estate (List Nepokretnosti) is the primary ownership document. Your lawyer must obtain a certified copy from the Real Estate Cadastre (UPN) and verify:

  • Sheet A: Description and area of the property
  • Sheet B: Registered owners and ownership shares
  • Sheet C: Mortgages, liens, easements, and any restrictions

⚠️ Never rely on photocopies — always request a fresh certified extract.

Building Permit Verification

Confirm the property has:

1. Valid building permit (Građevinska dozvola)

2. Use permit / completion certificate (Upotrebna dozvola)

Properties without a use permit cannot be legally sold and may be subject to demolition orders. This is particularly common with older properties and some beachfront developments.

Cadastre System

Montenegro uses eCadastre (ecadastre.me) for public parcel lookups. You can verify:

  • Parcel number and boundaries
  • Registered owner
  • Land category (residential, agricultural, forest)
  • Building status

Always get the cadastre parcel number (Broj parcele) from the seller to run your own check.

Urban Planning Check

Verify the property's designation in the local spatial plan (Prostorni plan). Some areas are zoned for tourism or have building height restrictions that affect future development.
